- is a homeworker
- was an employee

The ESA does not apply to independent specialists, volunteers or other individuals who are not covered under the ESA. An individual thought about a worker might be entitled to rights such as:
- minimum wage

How to inform who is a staff member
The relationship in between a specific and business (or person) they are working for determines whether the person is a worker and entitled to protections under the ESA. An individual might be thought about a worker under the ESA when a minimum of some of the following describes the relationship:
- the work the specific carries out is a vital part of the organization
- business chooses:- what the person is to do
- just how much the individual will be paid
How to tell who is an independent professional
An independent professional is someone who stays in business on their own. A person may be thought about an independent specialist, and not by the ESA, when at least some of the following uses:
- the business can end the individual's contract for services, however can not [discipline](https://mijnworkmate.nl) the person
- the individual:- has the opportunity to earn a profit and [employment](https://allmy.bio/jgukatheri) has a danger of losing cash from the work
- identifies how, when or where the work is performed
- chooses whether to farm out some of the work

Example
Fariah works as a customer support agent for a sales company. She must work Monday to Friday from 9:00 a.m. to 5:00 p.m. in the service's office. She uses the service's telephones and computer systems. She is paid $25.50 per hour. Her employment agreement does not have an end date, although her employer can fire or discipline her for bad efficiency. Her work agreement specifies that she is an independent specialist therefore she does not receive overtime pay, [employment](https://securityholes.science/wiki/User:JeromeMusser865) holiday pay or [public vacation](https://elmersfireworks.com) pay.
Fariah thinks she might actually be a staff member and may be entitled to overtime pay, holiday pay and public holiday pay. She sues with the Ministry of Labour, Immigration, Training and [employment](https://securityholes.science/wiki/User:RosemarieSteinke) Skills Development.
A work requirements officer investigates her claim. The officer looks at the relationship in between Fariah and [employment](https://allmy.bio/bellaxcs21) the sales service and finds that she is a staff member
It does not matter that Fariah signed the employment agreement stating that she is an independent contractor since the facts show she is a staff member.
The employment requirements officer orders the sales organization to:
- pay Fariah the overtime pay, holiday pay and public vacation pay that she was entitled to as a staff member.
- orders the company to issue wage declarations and keep records
Employee or independent professional: Common mistaken beliefs
An individual might be considered a worker even if:
- the specific and the company agree (orally or in composing) that the person is an independent professional. It is the relationship between the individual and the business (or individual) that matters, not the label that is provided to it
- the person:- charges the harmonized sales tax (HST).
- sends invoices to the business.
- utilizes their own lorry for work purposes.

Volunteers
Volunteers are not staff members under the ESA. However, the truth that someone is called a "volunteer" does not identify whether that individual is a worker and entitled to the securities of the ESA.
The main aspects that determine whether somebody is a volunteer or a staff member are how much:
- business (or individual) benefits from the person's services.
- the individual views the plan as being in pursuit of a living.
In family-run businesses, the question will often be whether the person is offering services in pursuit of a living or in service of the household.
If the individual is supplying services to the family, rather than services in pursuit of a living, that individual is more most likely to be a volunteer.
The reality that no incomes were paid does not always indicate that someone is a volunteer. The fact that there was some kind of payment does not necessarily indicate somebody is a worker. For example, an honorarium might have been paid, rather than earnings.
